Terms of Service
Last updated: August 30, 2026
Welcome to CapVoxa. These Terms of Service (“Terms”) are an agreement between you and the provider of the CapVoxa applications, extensions, website, and related services (together, the “Services”).
By downloading, accessing, purchasing, or using the Services, you acknowledge that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility and guardian consent
You must be at least the minimum age required in your country or region to consent to digital services and form a binding contract. If you cannot independently enter into a contract, a parent or legal guardian must read and accept these Terms, and you may use the Services only under their supervision.
If you use CapVoxa on behalf of an organization, you represent that you have authority to bind that organization. In that case, “you” also means the organization.
When the Services are distributed through an Apple platform, you must also comply with the applicable Apple Media Services Terms, App Store rules, and device terms.
2. The Services
CapVoxa provides AI-powered speech, image, and text features, including real-time conversation translation, earphone or speaker translation, face-to-face mode, floating captions, text, camera, and object translation, comic or webpage text translation, AI notes, speech synthesis, and voice cloning.
Specific features, supported languages, models, speeds, free allowances, paid tiers, and device requirements may vary by version, region, network, system permission, or provider availability. Product pages, screenshots, and demonstrations illustrate an intended experience; they are not a promise that every feature will always be available, perfectly accurate, or suitable for every context.
Some features require internet access, while some content is stored locally on your device. You are responsible for device, network, carrier, and third-party website charges.
3. Limited license
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Services on compatible Apple devices that you own or control.
Except where applicable law expressly permits it, you may not copy, rent, sell, sublicense, publicly distribute, modify, reverse engineer, decompile, circumvent technical protections, or otherwise exploit the Services, model interfaces, or related software. CapVoxa and the relevant rights holders reserve all rights not expressly granted to you.
4. Your content and permissions
“User Content” includes speech, text, photos, documents, comics, webpage content, transcripts, and notes that you submit, record, import, save, or select for processing.
You retain your existing rights in User Content. To provide the feature you request, you grant us and our processors a limited, non-exclusive license to process User Content only as necessary to receive and transmit it, recognize speech or text, translate, generate, convert formats, store content that you choose to save, maintain security, and resolve your support request. This license ends when the relevant purpose and any legally required retention period end.
You represent and warrant that:
- you own the User Content or have the rights and consents required to submit and process it;
- using the User Content will not violate another person’s privacy, copyright, trademark, voice, publicity, personality, or other rights;
- you will comply with local laws governing conversation recording, monitoring, screen broadcast, international transfers, and sensitive information; and
- you will not ask CapVoxa to process content that was unlawfully obtained or that you have no right to use.
CapVoxa does not claim ownership of your User Content and has no obligation to back up content that exists only on your device. Keep your own copy of notes or translation results that you need to retain.
5. Recording, captions, and voice cloning
Consent requirements for recording, monitoring, captions, and voice processing differ by jurisdiction. Before recording or processing another person’s voice, you must clearly inform participants and obtain any consent required by law. Do not use these features where recording is prohibited.
Voice cloning may be used only for your own voice or a voice for which you have explicit, valid authorization. You may not impersonate another person, falsify authorization, or use a synthetic voice for deception, harassment, defamation, election manipulation, identity theft, fraud, or other harm. We may request evidence of authorization and refuse or remove a cloned voice when we reasonably suspect misuse.
You can delete a cloned voice in Settings. See the Privacy Policy for information about voice samples, consent records, and provider processing.
6. AI and translation output
The Services use automatic speech recognition, machine translation, and generative AI. Output is probabilistic and may be incomplete, inaccurate, outdated, inappropriate, or different across requests. Background noise, accents, overlapping speakers, connectivity, image quality, and specialist terminology can affect results.
You must independently verify important information before relying on output. CapVoxa does not provide legal, medical, financial, immigration, employment, or other professional advice and must not be your sole communication or decision tool for:
- emergency calls, rescue, medical diagnosis, or medication;
- legal rights, visas, contracts, policing, or court proceedings;
- financial transactions, identity verification, safety instructions, or high-risk work; or
- any situation in which an error could cause personal injury, substantial property loss, or loss of rights.
Use a qualified interpreter, professional adviser, or official emergency service when appropriate. You are responsible for interpreting, verifying, and using output.
7. Permissions, privacy, and security
Some features require microphone, speech-recognition, camera, Photos, notification, or screen-broadcast permissions. You can withdraw a permission in system settings, but the related feature will stop working. We process information as described in our Privacy Policy.
You are responsible for securing your device, unlock credentials, and locally stored content. If a device is lost, shared, or accessed by another person, local notes, recordings, or translation results may be exposed. If you suspect unauthorized use, end the relevant session and contact us.
8. Third-party services and Apple terms
The Services rely on Apple, speech, AI, cloud-infrastructure, and website-hosting providers. Third-party services may be interrupted, changed, or governed by their own terms and privacy policies. When you visit a third-party website through the in-app browser, your interaction is with that third party. CapVoxa does not control its content, security, cookies, payments, or availability.
To the extent applicable, you acknowledge that:
- these Terms are between you and CapVoxa, not between you and Apple;
- Apple is not responsible for maintaining or supporting the Services or addressing third-party claims;
- if the Services fail to conform to an applicable warranty, you may notify Apple under Apple’s rules, and Apple’s responsibility is limited to any refund obligation stated in those rules; and
- Apple and its subsidiaries are third-party beneficiaries of the provisions concerning the App Store application license and may enforce those provisions.
This section does not limit non-waivable consumer rights or any rights Apple provides under its own terms.
9. Free allowances, subscriptions, and extra usage packs
CapVoxa may offer free allowances, auto-renewing subscriptions, free trials, and one-time extra usage packs. Before purchase, the App Store page and system confirmation sheet display the applicable price, currency, billing period, trial terms, included allowance, and other material limits. That purchase information forms part of these Terms.
Auto-renewing subscriptions
- Apple charges your Apple ID account when you confirm the purchase;
- the subscription automatically renews unless you turn off auto-renewal before the current period ends as required by Apple; Apple generally requires cancellation at least 24 hours in advance;
- the renewal charge may be made within 24 hours before the current period ends;
- you can manage or cancel a subscription in the Apple ID subscription page in system Settings;
- deleting CapVoxa does not cancel a subscription; and
- if a free trial is offered, any unused portion may be forfeited when you purchase a subscription, as disclosed on the purchase screen.
Extra usage packs
Extra usage packs are one-time digital purchases and do not auto-renew. Available features, allowance, expiration, and other limits are shown at purchase. Used or settled digital allowances generally cannot be withdrawn or redeemed for cash, except where applicable law requires otherwise.
You can use Restore Purchases for entitlements that Apple makes restorable. Apple handles refunds, reversals, and billing disputes under its rules and applicable law. We do not have direct access to your full payment method and cannot guarantee approval of a refund.
We may change future pricing, plans, or allowances, but we will not retroactively reduce a fixed entitlement that you already purchased without a lawful basis. Subscription price changes will be notified as required by Apple and apply to a later billing period.
10. Acceptable use
You may not:
- use the Services for unlawful, fraudulent, harassing, threatening, discriminatory, defamatory, or rights-infringing activity;
- secretly record, monitor, or clone a voice without required consent, or process highly sensitive content without authority;
- upload malicious code or attack, scan, disrupt, or damage the Services or another person’s device or data;
- bypass allowances, subscriptions, access controls, content restrictions, or security measures;
- access the Services through bots, scripts, bulk requests, scraping, or unauthorized interfaces;
- resell or share paid entitlements, or use the Services without permission for a service bureau, training a competing model, or building a substitute product;
- impersonate another person or misrepresent identity, authorization, source, or affiliation with CapVoxa;
- use output to make an automated decision that directly produces legal or similarly significant effects on another person; or
- encourage or assist anyone to do any of the above.
We may use reasonable technical measures to investigate and stop abuse, including rate limits, feature suspension, and retention of necessary security records.
11. Intellectual property and feedback
The CapVoxa software, interfaces, designs, trademarks, copy, graphics, and other Service materials are owned by CapVoxa or its licensors and protected by intellectual-property law. Third-party names, marks, and content belong to their respective owners.
If you submit suggestions, ideas, or feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use, modify, and implement that feedback without payment or attribution. This license does not include conversations or other User Content that you submit for translation.
If you believe material in the Services infringes your rights, send a notice identifying the rights holder, protected work, location of the challenged material, contact details, and a good-faith statement to the contact email below.
12. Changes, suspension, and termination
We may update, add, limit, or discontinue features for security, maintenance, legal compliance, provider changes, or product improvement. When a change materially affects paid entitlements, we will provide advance notice where reasonably practical and comply with applicable law and Apple requirements.
We may limit, suspend, or terminate access to all or part of the Services if you materially or repeatedly violate these Terms, create a security risk, fraudulently use entitlements, or if law requires action. An urgent security incident may prevent advance notice. You may stop using and delete the app at any time, but doing so does not automatically cancel a subscription or remove obligations incurred before termination.
13. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We do not warrant uninterrupted, error-free, or absolutely secure operation; compatibility with every device or third-party service; or that any transcription, translation, summary, synthetic voice, or other output will be completely accurate or fit for a particular purpose.
We are not responsible for third-party websites, models, networks, carriers, Apple services, or device environments outside our control. These Terms do not limit non-excludable warranties, consumer-law rights, or statutory remedies.
14. Limitation of liability
To the maximum extent permitted by law, CapVoxa, its provider, affiliates, and service providers will not be liable for lost profits, revenue, data, goodwill, or business opportunity, or for indirect, incidental, special, punitive, exemplary, or consequential damages, even if advised that such damages were possible.
To the maximum extent permitted by law, our total liability arising out of the Services or these Terms will not exceed the amount you paid for CapVoxa during the 12 months before the event giving rise to the claim. These limits do not apply to personal injury caused by willful misconduct or gross negligence, fraud, or other liability that cannot lawfully be limited. If your jurisdiction does not allow a particular exclusion or limit, it applies only to the extent permitted there.
To the extent permitted by law, you are responsible for third-party claims caused by your unlawful use of the Services, lack of rights in User Content, recording or voice cloning without consent, or material breach of these Terms. This paragraph does not shift liability to a consumer where the law prohibits doing so.
15. Disputes, governing law, and general terms
If a dispute arises, contact us first at the address below so that we can try to resolve it in good faith. Applicable law and a competent court will be determined under the relevant conflict-of-law, jurisdiction, and mandatory consumer-protection rules governing the provider and your location. These Terms do not deprive you of non-waivable consumer rights under the law where you live.
If a provision is found invalid or unenforceable, the remaining provisions remain effective, and the affected provision will be enforced as closely as legally possible to its intended effect. A failure to enforce a right is not a waiver. You may not assign these Terms without our written consent. We may assign them as part of a reorganization, merger, asset transfer, or change in Service operator, without reducing your statutory rights.
These Terms, the Privacy Policy, and any conditions expressly incorporated on a purchase screen are the entire agreement concerning the Services. Provisions that by their nature should continue—including User Content licenses, intellectual property, payment, disclaimers, liability limits, and disputes—survive termination.
16. Changes to these Terms and contact
We may update these Terms to reflect changes to the Services, billing, providers, or law. We will provide notice of material changes in the app, on the website, or by another reasonable method and update the date above. Unless law requires immediate effect, material changes normally apply prospectively. Continuing to use the Services after an update takes effect means you accept the revised Terms.
